Property Rights in Celtic Irish Law

Today’s document is an article written by Joseph Peden that was taken from the Vol. 12 #1 issue of the Journal of Libertarian Studies, which was originally presented at a symposium given during January of 1973. It is an examination of the Irish tuath private legal system, and how it differs from the English common law. Footnotes have been removed from the reposting of this article for brevity and clarity of reading.

It is impossible at the present time to present a systematic, coherent description of the ancient Irish law of property. The reason is that a considerable portion of the sources have not been published in modern scientific textual editions and translations. The principal sources used repeatedly by historians in the 19th and early 20th centuries are the multi-volumed editions of the old Irish law tracts edited and translated by Eugene O’Curry and John O’Donovan and published posthumously by other editors between 1865 and 1901. While both these pioneer scholars were competent in their understanding of Middle and early Modern Irish, the language of the glosses and commentaries, neither was able to cope too successfully with the archaic and very technical terminology of the Early Irish texts of the law – the oldest and most valuable strata for understanding Irish legal concepts and principles. The later editors of the O’Curry – O’Donovan transcriptions and translations were, with one exception, almost wholly ignorant of the Irish language, and the result was that their footnotes were misleading and inaccurate, their introductory essays teemed with misinterpretations, and the printed texts themselves were full of glaring errors. People ought to collaborate whenever they can in order to achieve their goals. Individuals who become familiar with each other have the potential to develop a molecular level bond of trust, which is essential for the smooth operation of any activities they may choose to perform. Allodial “Legally” Defined

The following definitions for “allodial” are taken from Ballantine’s Law Dictionary (3rd edition), Black’s Law Dictionary (2nd edition), and Webster’s Dictionary (1828):




The tenure of an estate by an owner in fee simple under the state as sovereign, as opposed to feudal tenure. The dominion is absolute and direct, subject only to escheat in the event of failure of successors in ownership.
